'Unusual' bail to ex-DIG of prisons: HC rebukes trial court judge

In the full text of a verdict, the High Court has warned Judge Md. Iqbal Hossain, Special Judge Court-5, Dhaka, for granting bail in an "unusual way" to Partha G. Banik, suspended deputy inspection general (prisons), of Sylhet Division in a case involving Tk 80 million from his Dhaka home.

"The High Court had previously directed the trial court not to grant Partha Gopal Banik bail, but to speed up the proceedings against him." Judge Md. Iqbal Hossain, Special Judge Court-5, Dhaka, has granted bail to Partha Gopi Banik, despite the High Court order," Justice M Enayetur Rahim, Justice Md Mostafizur Rahman, and the HC bench of Justice M Enayetur Rahim observed in the full text released today.

The full text of the verdict states that judges must render verdicts and orders in open court in all cases.

The HC bench issued a brief verdict on September 2 that rescinded the lower court order granting bail to Partha Gopal Bnik in the corruption case.

Judge Md Iqbal Hopsain was warned by the bench not to assume any further responsibilities.

The verdict was delivered by the bench following an appeal filed in the Anti-Corruption Commission. This appeal challenged the order of Judge Md. Iqbal Hossain, Special Judge Court-5 Dhaka, granting bail to Partha gopal banik at the end of court hours without prosecution.

Khurshid Alam Khan, ACC's lawyer, told the HC that Partha Gopal Banik was granted bail by the judge in an unusual way on June 17, although there are specific allegations against him.
